Terms of Service

1. General Terms

  • Chris Colyard Photography (“we,” “our,” “us”) provides photography services, digital images, and printed products.

  • These Terms apply to all users of our website, including clients, visitors, and vendors.

  • We reserve the right to update or modify these Terms at any time. Continued use of our website after any changes constitutes acceptance of the updated Terms.

2. Booking & Payments

  • A non-refundable deposit is required to confirm all bookings.

  • The balance is due on or before the day of the session unless otherwise stated.

  • Sessions are not confirmed until a deposit is received.

  • Deposits and payments can be made via cash, card, bank transfer, or our approved online payment platform (Fygaro).

  • Prices are subject to change without notice but will not affect confirmed bookings.

3. Cancellations & Rescheduling

  • Deposits are non-refundable under all circumstances.

  • If you need to reschedule, please contact us at least 72 hours before your session.

  • Failure to attend your appointment without notice will result in forfeiture of your deposit.

  • Rescheduled sessions must be completed within 30 days, subject to availability.

4. Delivery of Images

  • Proof galleries are typically delivered within 7–14 business days after your session.

  • Final edited images are delivered via secure online gallery or USB (where applicable).

  • Galleries remain available online for a limited time, after which they may be archived or removed.

  • Clients are responsible for downloading and safely backing up their images once delivered.

5. Image Ownership & Usage Rights

  • Chris Colyard Photography retains full copyright ownership of all images captured during sessions.

  • Clients receive personal usage rights for printing and sharing images for personal, non-commercial purposes.

  • Commercial or promotional use requires written permission or a commercial license.

  • We reserve the right to use selected images for our portfolio, website, social media, and marketing materials, unless otherwise agreed in writing prior to the session.

6. Editing & Retouching

  • All images are edited in our signature style.

  • Additional retouching requests (e.g., body modifications, background changes) may incur extra fees.

  • Raw, unedited images are not provided under any circumstance.

7. Prints & Products

  • All print sales are final and non-refundable.

  • We are not responsible for color variations between screen displays and printed products.

  • Replacement will only be provided for damaged or defective items reported within 48 hours of receipt.

8. Client Conduct

  • Clients are expected to arrive on time and prepared for their session.

  • Late arrivals may result in reduced shooting time without a refund or reschedule.

  • We reserve the right to refuse service to anyone displaying inappropriate, disrespectful, or unsafe behavior.

9. Limitation of Liability

  • While we take every precaution to ensure a smooth experience, Chris Colyard Photography is not liable for any loss, damage, or injury arising from the use of our services or website.

  • In the unlikely event of equipment failure, data loss, or unforeseen circumstances, our liability is limited to the return of payments received for the affected session.

10. Privacy

11. Governing Law

These Terms are governed by the laws of Jamaica, and any disputes shall be handled in the relevant courts of Jamaica.
